The Colorado man suspected in a massacre at a movie theater that killed a dozen people, sat silently in his first court appearance, his hair a shocking shade of red.

Twenty-four year-old James Eagan Holmes did not say a word during the brief hearing.

He is being held on probable cause for first degree murder and prosecutors say they will likely file charges next week.

Arapahoe County District Attorney Carol Chambers says no decision has been made about whether they will seek the death penalty.

SOUNDBITE: Arapahoe County District Attorney Carol Chambers saying:

"So it is months down the line still. But we will over the course of those months be talking with all of the victims, developing relationships just so they know who we are and who they can talk to, and that will take some time in this case."

She says prosecutors are wading through an enormous amount of evidence. Twelve people including a young girl were killed in the attack at a midnight showing of the new Batman film. Fifty-eight people were injured.
