California’s new ban concerning the sale of foie gras, the fatty delicacy made from goose or duck liver has now triggered a lawsuit. Several producers and restaurants have joined forces and hope to have the ban removed. The lawsuit claims the state’s ban on the sale of force-fed birds, which results in the increase of liver size, is ‘unconstitutional’. While animal rights activists preach for a country wide ban, calling foie gras “a diseased product unfit for human consumption”, the legal ban puts responsibility on the individual, whether it be chef, restaurant or producer to have knowledge about what and how the duck was fed during its entire life.

The penalty for breaking the foie gras law could result in in a $1,000 dollar fine initially and up to another $1,000 each day the violation continues. Many are claiming there are too many loopholes in the law. One California restaurant has initiated a ‘Bring Your Own Foie’ policy, meaning customers bring the product, the chef will cook it.
