குற்ற பின்னணி கொண்ட அரசியல்வாதிகள் குறித்த வழக்கில் இந்திய தலைமை நீதிபதி தீபக் மிஸ்ரா கொடுத்த சுளீர் தீர்ப்பு இதுதான். எம்பி, எம்எல்ஏக்களுக்கு எதிராக குற்ற வழக்கு தொடுக்கப்பட்டுவிட்டால் அவர்களை தகுதி நீக்கம் செய்ய வேண்டும், அவர்களை தேர்தலில் போட்டியிட அனுமதிக்க கூடாது என்று வழக்கு தொடுக்கப்பட்டு இருந்தது.
