Sahara India chairman Subrata Roy was released from Tihar jail on Friday evening on a four-week parole to attend last rites of his mother, who died the same morning.
Although the Supreme Court directed the release of the Sahara chief, it directed that he would be under protective custody of police.
The court also sought an assurance from Roy's counsel Kapil Sibal that he would not try to escape or run away.
