On the night of Saturday, May 2, 22-year-old Juan Moreno Lopez was walking down the street in San Jose, California when police approached him. According to the police report, Moreno Lopez pitched something into the bushes and took off running.

He ran into the street, where police say they confronted him and threatened them with a bottle before they were able to subdue him. When they had the suspect on the ground, witnesses pulled up to take a video of the altercation and beg the officers not to use violence.

Police in the video can be seen surrounding Moreno Lopez while using batons and their fists to hit the unarmed man. Although police say that he was resisting, there is no footage of what happened moments before they pinned him to the ground, and there is an internal investigation underway to find out what really happened.

Moreno Lopez was taken to the hospital to be treated for the police inflicted injuries before being charged with suspicion of assault with a deadly weapon, resisting arrest, being under the influence of a stimulant, possession of methamphetamine and destruction of evidence.
