A Minnesota attorney has been charged with first degree felony assault and two counts of first degree felony arson after he allegedly set his girlfriend on fire at her Burnsville condo following an argument.
In a report to police, the victim told how she had fallen asleep on the couch on Feb. 9 after drinking and taking medication while David J. Gherity, her boyfriend of 10 years, was at her apartment. She said he was stressed.
After she fell asleep, police allege that Gherity then doused his girlfriend with nail polish, nail polish remover and hairspray before setting her alight and leaving.
Responding to a fire alarm, firefighters arrived in the smoke-filled condo to find the woman sitting at the table on fire.
The victim lost an ear as a result of the attack and suffered second and third degree burns to several parts of her upper and lower body.
A police investigation showed that the victim had left a voicemail for her sister in the minutes before the fire.
In the voicemail she said that Gherity had gone berserk.
"I can't call now, I'll call you later," she had whispered.
Gherity, who showed up at the hospital after the attack covered in soot and reeking of smoke, denied being in the apartment when the blaze started.
