However, a majority of the debt was in my name solely because my credit was higher. There is no real estate or auto involved, just credit cards and such. He plans on filing bankruptcy after the divorce is final in July. If we put on our divorce filing that he will assume 100% of all debt that was jointly accrued, even if it was in MY name, will he be able to assume that debt when he files bankruptcy even though it was not on his name originally? We both just want to put as much of the debt on his plate as possible if he'll be filing for BK anyway... What can we do? -
