Harvey Palacio says he was the victim of racial discrimination in the workplace at Intel after he was targeted in a kick me prank, according to a federal lawsuit.
Palacio, who worked at the Rio Rancho Intel plant in Albuquerque, New Mexico, said in a complaint recently filed in Albuquerque that he cried after his coworkers humiliated him with a "kick me" prank.

According to court documents, the Intel employee said he thought someone had taped something to his back. When he asked senior staffer Randy Lehman for help, another employee said: "Don't read it, just do it," and Lehman kicked three times. As Palacio was seeking help elsewhere, another colleague Chris Zeltinger, kicked him twice.
Palacio believes he was discriminated against because he is Filipino. He is seeking an unspecified amount in damages and legal fees. Lehman and Zeltinger have already been convicted of petty misdemeanor battery and sentenced to 60 hours of community service. They and were fired by Intel for their involvement in the prank.
