Passenger sues airline after crew claimed he didn't flush toilet

A man is suing Virgin America for being detained at a San Francisco airport after complaints from aircrew that he swore at them and didn't flush the toilet after use.

Trouble started when Salvatore Bevivino, 52, had difficulty ordering through the in-flight touchscreen system and summoned a flight attendant to take his drink order.

The flight attendant insisted he use the system. A second attendant also refused to take his order verbally. Finally, a third attendant brought him his drink.

Bevivino then went to relieve himself. Crew claimed he didn't flush and returned to his seat smirking and behaving rudely.

As he disembarked, the pilot told him he'd been flagged as a "person of suspicion."

He was later taken away by uniformed FBI and TSA agents.

Bevivino was later released without charge and is seeking $500,000 from the airline, claiming he suffered humiliation and mental anguish.
