There are three ways the State of Massachusetts can pursue an Assault and Battery case -- even if the alleged victim does not wish to pursue charges.
1. An independant witness can be questioned by the State. It is as easy as calling someone and asking them what occured. If there is just one independant witness the case can proceed forward.
2. A recorded 911 call can come into evidence.
3. Admissions by you of unlawful acts
Each and all of these 3 pursuits of the State may be challenged in your defense. They may be legally insufficient but the State will try to pursue them.
