A bizarre case has landed in New Castle County Superior Court. 44-year-old Daniel Metzgar, who works as a truck driver, has initiated a medical malpractice lawsuit.

Metzgar lived with a constant erection for eight long months. In 2009, he underwent a penile implant, which was performed by an urologist in Wilmington, Dr. Thomas J. Desperito.

Metzgar is alleging the doctor botched the procedure, which involved having a three-piece inflatable device implanted into his genitals.

Following the surgery his scrotum swelled to the size of a volleyball and he got an erection that never went away. Metzgar returned to Desperito’s office four months after the surgery to report the problems.

He was told to have the device taken out, but he didn’t have health insurance and couldn’t afford to pay out-of-pocket. It was removed after several more months by another doctor, only after the tubing punctured his scrotum.

In leiu of the problematic first surgery, Metzgar has lost sensation in his penis. He also encountered a 50 % size reduction. He is suing Desperito for unspecified damages.
